Terms and Conditions of GLS Spain

1 - Object

This conditions will be applied for all activities carried out by GLS Spain, in particular dispatching, handling, procedures, storing and all management fulfiled for the parcel transport by means of hauliers in Spain and in those countries belonging to GLS international network.


2 - Goods acceptance for transport, exclusions

2.1 Bulks with unitary weight up to 50 kg are accepted. Its radius does not have to exceed 3 metres, and accepted individual dimensions will be a maximum of 2 metres in lenght, 0.6 metres in height and 0.8 metres in width.

2.2 The following goods are not accepted: products without beeing packaged or inadequately packaged with regard to standard packaging measures, perishable goods, remains, living animals, valuables such as money, precious metal, jewellery, works of art, telephone cards, mobile phone prepayment cards, titles and other monetary value documents, products requiring specific temperature storing, weapons and munitions, dangerous products. Personal effects, alcohol and ATA cards are not accepted either.

2.3 GLS Spain is not responsible for damages or losses of received parcels in contravention of listed exclusions in 2.2 article, except in those cases which GLS has issued its consent in writing.

2.4 Those parcels which are not suitable for automatic sorting, will be only accepted by means of exceptional agreement.


3 - Service field

3.1 GLS Spain, as expedition agent, is responsible for supplying the following transport services, which will be carried out by independent hauliers.

3.1.1 Pick up and transport of received parcels and delivery at consignee´s premises.

3.1.2 Received parcel delivery at the departure depot, within GLS standard delivery time, ranging from 24 to 120 hours. It is not ensured or guaranteed that delivery will be carried out within standard delivery time.

3.2 Delivery is carried out at consignee´s reception address or at “goods arrival” department.

3.3 Up to a maximum of two delivery attempts are free.

3.4 Bulks delivery is carried out by getting consignee´s signature or other authorized people, in particular presence people or neighbours.

3.5 Proof of delivery will be provided free of charge as long as it does not exceed usual limits (5% consignor´s received daily parcel average).
GLS Spain has the right to invoice reasonable prices when providing proof of delivery when this limit is exceeded.

3.6 GLS Spain uses electronic methods to obtain proof of delivery in some cases. The consignor hereby confirms their will to accept consignee´s signature digitization and its reproduction as proof of delivery.

3.7 Parcel weight determined by GLS Spain will be retrieved from data base when showing reference.


4 - Consignor´s obligations

4.1 Every parcel has to have and/or come with properly filled in documents and approved by GLS Spain. The consignor accepts consequences of any error in their conclusion.

4.2 It is the consignor´s responsability to make sure of the parcel proper packaging.


5 - Responsabilities

5.1 GLS Spain is responsible for losses or damages to parcels that are in its care up to a quantity of (LOTT, domestic consigment) euros/kilo and (CMR, international consigment) euros/kilo of the parcel gross weight. GLS Spain will not be responsible for consequence or extraordinary damages or profit (including income loss, profits or markets, image loss, damages produced by parcel content use impossibility, or business chance loss).

5.2 CMR conditions in haulier responsability will be applied to road international transport and LOTT conditions to domestic transport. However, in case of claim after delivery on the part of the consignee, GLS Spain will not be responsible if reservation “except examination” does not appear on the proof of delivery.


6 - Insurance

Standard insurance: In the cases when consignor has not contracted any transport insurance, GLS Spain will renounce stipulated responsability limitation in the first statement of point 5.1 paragraph 1 and will consolidate goods value up to a quantity not exceeding 750 Euros (international) and 520 Euros (domestic).
In this case, consignee´s sworn statement is required, stating that goods to claim were not previously insured.
Unless it is expressly agreed in writing, any agreed deduction between consignor and insurer does not constitute arguments for a correspondent refusal on behalf of GLS Spain.


7 - Complaint expiry

7.1 One year will be the maximum period for any claim against GLS Spain.

7.2 Your right to complain about parcel damages to GLS Spain will expire unless judicial complaint has been lodged within the following year: on parcel delivery date, date when it had to be delivered or when transport was stopped. Art. 32 conditions about CMR will be implemented to complaint expiry concerning international deliveries.

7.3 In the event of an existing complaint based on this present contract, outstanding invoce payment could not be held by the customer, even partly, having to pay according to agreed method and period.


8 - Writing requirements

Any subsidiary agreement or conditions that differ over this standard conditions, will not be valid if it is not in writing.


9 - Law and Jurisdiction

9.1 In the event of some of the current clauses were declared as null or impossible to be fulfilled, such declaration will not affect the rest of stipulations in this Transport Contract, which will remain in force.

9.2 Both parties agree to expressly renounce corresponding jurisdiction, stablishing courts in the city of Barcelona, Spain.

9.3 Likewise, both parties agree that Spanish law will be the applicable one.


10 - Contract limitations

GLS Spain reserves the right to rescind the present trade contract in the event of failure to comply with payments according to agreed terms.
